BREAKING UPDATE: Wade Wilson Remains on Florida’s De@th Row as His Legal Challenge Moves Through the State’s Highest Court!hl

FORT MYERS, FLORIDA — Wade Wilson remains on Florida’s dєatᩚh row as his legal battle continues following a series of challenges to the dєatᩚh sentences imposed for the 2019 murders of Kristine Melton and Diane Ruiz.

Wilson was convicted in 2024 of two counts of first-degree murder and was sentenced to dєatᩚh in August of that year. He is currently incarcerated at Union Correctional Insтιтution, Florida’s facility for male dєatᩚh-row prisoners. There is no imminent exє𝔠uti☉n date for Wilson.

The latest legal fight has focused not on whether Wilson was convicted, but on whether his dєatᩚh sentences were lawfully imposed.

THE FOCUS: FLORIDA’S dєatᩚh-SENTENCING LAW

One of the central issues raised by Wilson’s defense concerns Florida’s 2023 change to its capital-sentencing law.

Under the revised law, a jury does not have to reach a unanimous recommendation before a judge can impose a dєatᩚh sentence. A minimum 8-to-4 vote in favor of dєatᩚh is sufficient under the statute.

Wilson’s jury recommended dєatᩚh by votes of 9-3 for Melton’s murder and 10-2 for Ruiz’s murder. His attorneys argued that applying the revised sentencing framework to a case involving murders committed in 2019 raised consтιтutional and retroactivity questions.

That argument has encountered major obstacles.

When Wilson’s attorneys appeared before the Florida Supreme Court in February 2026, the planned challenge was abruptly halted. His lawyer acknowledged that recent court decisions had undermined the arguments he intended to present.

The development did not mean Wilson was released or that his convictions were overturned. Instead, it represented a setback for that particular challenge to his dєatᩚh sentence.

THE FLORIDA SUPREME COURT HAS ALREADY RULED ON HIS CASE

The Florida Supreme Court has previously addressed Wilson’s direct appeal and rejected numerous arguments challenging his convictions and dєatᩚh sentences.

Among the issues addressed were claims concerning jury selection, the consтιтutionality of capital punishment and other alleged errors. The court concluded that Wilson was not enтιтled to relief on those claims.

His defense nevertheless continues to pursue available legal avenues.

That distinction is important in capital cases: a dєatᩚh sentence does not automatically lead to an immediate exє𝔠uti☉n. Appeals and post-conviction proceedings can continue for years, and additional legal challenges may be filed before an exє𝔠uti☉n can proceed.

WHY WILSON REMAINS ON dєatᩚh ROW

The case stems from October 7, 2019, when prosecutors said Wilson killed two women in Cape Coral within hours of each other.

Kristine Melton, 35, was killed after Wilson met her at a Fort Myers bar and accompanied her home. Later that morning, Wilson encountered Diane Ruiz, 43, and prosecutors said he lured her into a vehicle before 𝘬iᩚlling her.

A Lee County jury convicted Wilson of the two murders in June 2024. The judge subsequently imposed two dєatᩚh sentences.

Wilson has therefore moved from the trial phase into a prolonged capital-litigation process in which the principal question is no longer simply what sentence the jury recommended, but whether every consтιтutional and statutory requirement for imposing and maintaining that sentence has been satisfied.

NO exє𝔠uti☉n DATE HAS BEEN SET

Despite the intense public attention surrounding Wilson’s case, there is currently no scheduled exє𝔠uti☉n date.

Recent reporting confirms that he remains incarcerated on Florida’s dєatᩚh row while his legal proceedings continue.

That means headlines suggesting that an exє𝔠uti☉n is imminent would go beyond the currently documented facts.

The legal picture is instead one of continued litigation, with Wilson challenging aspects of his dєatᩚh sentence while the state maintains the convictions and punishment imposed by the trial court.

For Wilson, the consequences of the 2019 murders remain permanent under the sentence currently in force: two dєatᩚh sentences and continued incarceration on Florida’s dєatᩚh row.

But the legal process is not finished.

Until the remaining avenues of review are exhausted—or a court changes the outcome—Wilson’s case remains active, with the Florida courts continuing to determine whether his dєatᩚh sentences withstand the consтιтutional challenges raised by his defense.
