The parents coming to Florida mom’s defense: ‘We were more independent than children are today’

In this era of helicopter parenting, how long is too long to leave kids home alone? And what’s the line between fostering independence in your kids and abandoning them?

That’s the debate on parent group chats in New York and beyond as a Florida mom faces a 𝘴h☉𝔠king arrest for leaving her four kids home alone.

Irene Miller, 50, was 𝘴ℓappєḋ with four counts of child neglect after allegedly leaving her children, ages 9, 11, 12, and 14, at their Kissimmee home while she traveled to Las Vegas for a five-day work trip.

Miller claimed that a sitter made frequent check-ins to the house, although the kids were left alone at night. And when a dumbbell fell on one kid’s head — and the others called 9-1-1 — police arrived at the scene, leading to Miller’s arrest.

Should she have been charged at all?

New York parents like Dr. Nina Izhaky aren’t sure.

Dr. Izhaky is a Manhattan dentist who told The Post she has real sympathy for Miller, especially in this economic climate.

“Childcare — especially overnight childcare — is the one thing money and planning still can’t reliably buy,” she said, noting that often, a sitter might cancel when the parent is already en route to a crucial work shift that’s needed to support the family.

“Then the overnight coverage that was supposed to exist doesn’t,” she told The Post.

Izhaky said there was a big difference between very young children being left alone overnight and an 11-year-old being trusted to remain independent for a few hours after school.

“That’s independence, and our generation was raised on it,” she said, referencing the Gen X and Millennial phenomenon of “latchkey” kids who regularly let themselves into empty homes after school every day while their parents worked later hours.

Florida attorney and mother of two Stacy Kemp Ferrari told The Post that when she first heard of Miller’s arrest, she assumed the children left alone were babies — not middle schoolers.

“I was honestly surprised to know the kids’ ages,” she said. “I thought they’d be toddlers, or at most 5-year-olds,” she said.

Ferrari noted that Miller’s children showed some independence by calling 911 when an emergency arose, and said that at those ages, without any neurodivergencies or disabilities, they likely know how to do basic things like make light meals, bathe, and get to school.

Still, even though she has sympathy for the skyrocketing cost of childcare, she drew the line at Miller’s lengthy absence.

“Five days seem like a stretch to me, even with a babysitter during the day,” Ferrari said. “That’s just courting danger.”

Marla Bautista, a Tampa mother of three, recalled being left unsupervised frequently during her own childhood.

“Times were different, and I believe that we were more independent than children are today,” Bautista told The Post.

Bautista has left her three children — age 16, 14, and 11 — alone for a full seven-hour workday, using cameras and phone calls to monitor them. But she’s never left them alone overnight, even though one of them can now legally drive a car.

Still, age alone isn’t necessarily a reliable measure of whether a child can handle being left unsupervised, according to childhood development experts.

Los Angeles family therapist Dr. Azita Sayan told The Post that certain 11-year-olds can show “far more” maturity and responsibility than some 16-year-olds. Depending on the circumstances, it’s not always necessary to hover over them throughout the day.

But Sayan said that even if a kid can handle themselves for several nights alone, that doesn’t mean they’re okay with the situation emotionally.

“Children can feel unwanted, uncared for, unsafe, anxious, depressed, angry,” Sayan warned of prolonged absences.

Still, she emphasized that children are resilient and that a single incident does not necessarily cause lifelong trauma.

Adding to the group chat debates: Laws around leaving your children alone are murky at best.

In fact, there is no minimum age for leaving your kids at home in Florida, New York, or California. Instead, it’s up to local authorities — as well as parents — to weigh in on the consequences of a child’s solo activities.

California family law attorney Thomas MacLean said the length of a parent’s absence is crucial.

“Going out of town for several days probably crosses the line,” MacLean told The Post.

Florida treats criminal child neglect as a felony, while New York and California have different charging standards and penalties, he added. And parents can face criminal consequences even if children don’t suffer injuries or duress.

Still, MacLean cautioned that working-class and lower-income parents may face greater challenges securing childcare, leaving them with fewer options.

The stigma is especially tough on moms, said New York-based author Shericka Thomas, who explained that working mothers are criticized even more than deadbeat fathers:

“If [a mother] were unemployed and unable to provide for [her children], people might criticize her for not doing enough and say, ‘A mother should do whatever she has to do to provide for her kids.’ Yet, when a mother goes to work to earn money for her family and struggles to find adequate childcare, she can face judgment for that, too,” she said.

While Thomas stressed that children’s safety must come first, she urged compassion for Miller’s decision to leave her adolescent kids alone during a crucial work period.

“Before we judge a struggling parent, we should ask ourselves whether we are offering solutions and support or simply adding to the burden,” she said.

“Parents should be held accountable for keeping their children safe, but they should also be treated with humanity and compassion.”
