Governor Bill Lee Says He Expects Christa Pike’s dєatᩚh Sentence to Remain in Place While an Independent Review Examines Why Two Doses of Pentobarbital Failed to 𝘬iᩚll Her

Tennessee Governor Bill Lee has stated that he suspects Christa Pike’s dєatᩚh sentence will stay the same as it was before the September 30 failed exє𝔠uti☉n unless the courts decide otherwise. Speaking to reporters in late October, Lee said that as it relates to a particular individual like Christa Pike and her crime, she remains incarcerated under the laws of the State of Tennessee. He added that he suspects her sentence will be the same as before unless determined otherwise by the courts. The remarks came in response to questions about whether the state would attempt to execute her a second time or whether he would commute the sentence to life without parole. Lee had previously denied a clemency peтιтion in the days before the scheduled exє𝔠uti☉n.

After the procedure failed, he ordered a comprehensive third-party review of what went wrong and paused the one remaining exє𝔠uti☉n that had been set for later in 2026, that of Gary Wayne Sutton. Former U.S. Attorney Ed Stanton was appointed to lead the independent review of the Tennessee Department of Correction’s actions in carrying out the sentence. Stanton previously reviewed the state’s lєthaℓ-inje𝔠ti☉n protocol in 2022. Department of Correction Commissioner Frank Strada resigned in the days after the failed exє𝔠uti☉n.

Lee named an interim commissioner and said the review would examine whether the established protocol was followed and whether additional recommendations are needed. Pike, who was 18 when she participated in the 1995 𝘬iᩚlling of Colleen Slemmer, received two doses of pentobarbital on September 30. She was taken from the exє𝔠uti☉n chamber to a hospital, remained unconscious and on a ventilator, and was later returned to prison after regaining consciousness. Her attorneys have described ongoing physical injuries and cognitive effects. No new exє𝔠uti☉n date has been set while the review is underway. Pike’s existing lawsuit challenging the protocol as likely to cause unnecessary pain remains active in chancery court.

The court has given her until late January 2027 to amend the complaint in light of the events of September 30. Lee has not indicated that he intends to intervene further in the individual case. He has framed the current pause as necessary so that the state can determine why an outcome that had not occurred in more than 100 previous uses of the same drug nationwide happened in this instance. The review and the pause are expected to continue at least through the end of 2026. In the meantime Pike remains on dєatᩚh row at the Debra K. Johnson Rehabilitation Center, and her lawyers continue to argue both that a second attempt would be unconsтιтutional and that the isolation in which she has been held since her return from the hospital violates an earlier settlement agreement.
