Governor Bill Lee Says He Expects Christa Pike’s dєatᩚh Sentence to Remain While Review Continues

Tennessee Governor Bill Lee has stated that he expects the dєatᩚh sentence imposed on Christa Pike to remain in place unless the courts rule otherwise, even as an independent review examines the reasons two doses of pentobarbital failed to 𝘬iᩚll her on September 30. Lee ordered the review and halted the state’s remaining scheduled executions for the year following the failed attempt. Pike, the only woman on Tennessee’s dєatᩚh row, was convicted in 1996 of the 1995 murder of Colleen Slemmer and has been incarcerated at the Debra K. Johnson Rehabilitation Center. The September 30 procedure was the first exє𝔠uti☉n of a woman in Tennessee in more than two centuries. After the attempt, Pike was hospitalized in ᑕriᩚtiᩚcal condition before regaining consciousness and returning to prison. Her attorneys have sought commutation to life without parole and have pursued multiple legal challenges, including the ongoing Davidson County Chancery Court lawsuit against Attorney General Jonathan Skrmetti that challenges the single-drug pentobarbital protocol adopted after an earlier review of prior exє𝔠uti☉n problems.

The October 23 hearing on a state motion to require amendment of the complaint was canceled after both parties waived oral arguments, leaving the matter for decision on the papers. Separate proceedings have resulted in an order preserving evidence from the failed exє𝔠uti☉n. Pike’s team has also raised claims that her current placement in the prison infirmary violates a 2024 settlement ending prolonged solitary confinement. The independent review ordered by the governor is expected to examine drug procurement, intravenous access procedures, personnel qualifications, and contingency planning. While the review proceeds, the legal questions of whether the protocol is consтιтutionally adequate as applied to Pike and whether a second attempt would consтιтute cruel and unusual punishment remain before the courts. Lee’s public position indicates that executive clemency is not anticipated in the absence of a judicial determination that the sentence cannot stand.

Christa Pike was sentenced to dєatᩚh in 1996 for the January 1995 torture-murder of 19-year-old Colleen Slemmer, a classmate at a Knoxville Job Corps center, a crime committed when Pike was 18. After more than three decades of litigation, including unsuccessful appeals in state and federal courts, the Tennessee Supreme Court set an exє𝔠uti☉n date of September 30, 2026. In January 2026 Pike filed a lawsuit in Davidson County Chancery Court against Attorney General Jonathan Skrmetti and others challenging Tennessee’s newly adopted single-drug pentobarbital protocol on consтιтutional and religious grounds, citing her medical conditions and the risk of a torturous exє𝔠uti☉n.

The case was briefly transferred to the Supreme Court and then returned. On September 30, after a last-minute stay was vacated by the U.S. Supreme Court, the exє𝔠uti☉n team administered two full doses of pentobarbital. Pike survived, was hospitalized unconscious and on a ventilator with severe arm injuries, regained consciousness around October 6, and returned to prison on October 10. Subsequent court actions include an order preserving all evidence from the attempt, efforts to amend the complaint with specific allegations of intravenous failures, and claims that isolation in the infirmary violates a 2024 settlement. The October 23 hearing on the state’s motion to require amendment was canceled after both sides waived oral arguments. A related hearing is set for November 6, with a trial currently scheduled for February 2027. Governor Lee has ordered an independent review, paused other executions, and indicated he expects the dєatᩚh sentence to stand absent a contrary court ruling. Pike’s first public statement on October 30 described continuous pain, isolation, and an effort to find meaning while recovering. The unresolved questions include whether the protocol can be applied to Pike without violating the Eighth Amendment, whether evidence of the September 30 events will be admitted, whether the 2024 settlement will be enforced, and whether the state will schedule a second exє𝔠uti☉n attempt. These issues will be decided through the ongoing chancery litigation and any subsequent appellate or clemency proceedings.
