Mother and Grandmother Sentenced in the dєatᩚh of 5-Year-Old Kinsleigh Welty

In late September 2026, an Indianapolis mother and her mother received formal prison sentences for their roles in the 2024 dєatᩚh of 5-year-old Kinsleigh Welty. Toni McClure, 31, was ordered to serve the rest of her life in the Indiana Department of Correction without the possibility of parole. Her mother, Tammy Halsey, 56, was sentenced to 20 years under a plea agreement that required her to testify against her daughter.

Kinsleigh Welty died in April 2024. Prosecutors established that McClure had confined the child to a filthy bedroom closet for months and provided her with very little food or water. Evidence presented in court showed that Halsey offered advice on the mistreatment through messages and at times used duct tape to restrain the girl. A third defendant, McClure’s former boyfriend Ryan Smith, was earlier sentenced to 20 years after admitting he knew about the conditions and failed to take action.

McClure was the only one of the three adults charged with murder. Her first trial ended in a mistrial in mid-2026 after a juror had improper contact with a witness. A second trial took place in August and early September. On September 1, a jury found her guilty of murder, criminal confinement, and battery on a person under 14. The following day, the same jury recommended a sentence of life without parole after roughly two and a half hours of deliberation.

On September 24, 2026, Marion Superior Judge James Snyder formally imposed that sentence. He described the case as among “the worst of the worst,” noting that testimony about the child’s treatment brought tears to crime-scene technicians, police officers, jurors, attorneys, and even the judge himself. Prosecutors vacated the battery and criminal confinement convictions after the murder conviction to avoid potential double-jeopardy issues, leaving the life sentence as the controlling punishment.

Halsey had pleaded guilty in December 2025 to neglect of a dependent resulting in dєatᩚh in exchange for the 20-year term and her cooperation. A social worker who spoke at sentencing said Halsey now encourages other mothers in jail to place trust in the child-protection system — a notable shift given the history of distrust both women described. Defense attorneys for McClure and Halsey pointed out that both had experienced 𝘢bu𝘴e in their own childhoods and that Halsey’s negative experiences within the foster care system contributed to a lasting suspicion of the Department of Child Services, a suspicion she pᴀssed on even as the pattern of harm continued.

Although the criminal cases against all three defendants have now concluded, civil litigation remains ongoing. Kinsleigh’s father and paternal grandfather have filed a lawsuit against the Indiana Department of Child Services. They allege that the agency dismissed or failed to adequately investigate at least five separate reports about the girl’s safety in the months leading up to her dєatᩚh. Judge Snyder remarked during the sentencing hearing that “so many people have failed Kinsleigh Welty.”

Marion County Prosecutor Ryan Mears described the investigation and trial as exceptionally difficult, saying the case “is going to stay with everyone forever.” The formal sentencing on September 24 marked the close of the criminal proceedings while leaving broader questions about systemic failures still unresolved in civil court.
