Patrick Clancy Fights to Hold Doctors Accountable for His Three Children’s Deaths as Lawsuit Faces Court Challenge

Patrick Clancy is pursuing a wrongful-dєatᩚh lawsuit against the medical professionals who treated his former wife, Lindsay Clancy, before she killed their three young children in Massachusetts in January 2023.

The case returned to court on October 28, 2026, when attorneys for the healthcare providers asked a judge to dismiss the lawsuit. Patrick’s legal team argued that the providers failed to properly address Lindsay’s deteriorating mєntal health, and that their alleged negligence contributed to the tᩚraɢedy.

The couple’s children, Cora, 5, Dawson, 3, and Callan, 8 months, died at their family home in Duxbury, Massachusetts, on January 24, 2023. Lindsay was accused of strangling the children before attempting sᩚuᩚiᩚcide by jumping from a window. She survived but was left paralyzed.

Lindsay has pleaded not guilty to three counts of first-degree murder, arguing that she was not criminally responsible because of severe postpartum mєntal illness. Her first criminal trial ended in a mistrial in September 2026 after jurors failed to reach a unanimous verdict.

Patrick’s civil lawsuit names psychiatrist Dr. Jennifer Tufts, psychiatric nurse practitioner Rebecca Jollotta, and their associated practices, Aster mєntal Health and South Shore Health. The complaint alleges that Lindsay was prescribed multiple psychiatric medications without adequate recognition or treatment of her worsening condition.

During Wednesday’s hearing, Patrick’s attorney, Howard Cooper, argued that the providers had been warned about Lindsay’s mєntal-health struggles and should have recognized the risk. He described the care she received as grossly negligent and said the alleged failures played a substantial role in the deaths.

Cooper also said Lindsay is expected to testify in the civil case after her criminal proceedings conclude. According to Patrick’s legal team, she will say that she communicated thoughts of harming herself and her children to her providers.

However, the medical professionals have disputed the allegations. Their attorneys argued that the providers did not have sufficient notice of an explicit threat against the children and maintained that they were not legally responsible for preventing the deaths.

The defense has also argued that Massachusetts law limits when mєntal-health professionals have a duty to protect third parties from a patient. Their position is that the lawsuit does not establish the legal basis needed for the claims to proceed.

The judge did not issue an immediate decision and took the dismissal request under advisement.

Patrick and Lindsay have filed separate civil lawsuits against healthcare providers. Lindsay’s own lawsuit alleges that her treatment failed to identify her condition and that medication decisions worsened her mєntal health. Those allegations, like Patrick’s claims, remain subject to legal proceedings.

The civil case is separate from Lindsay’s criminal prosecution, and the mistrial did not resolve whether she can be held criminally responsible. Prosecutors have been considering the next steps in the criminal case.

For Patrick, the lawsuit represents an effort to obtain accountability for the loss of his children. For the providers, the court proceedings will determine whether the allegations against them can be litigated.

The judge’s forthcoming decision on the dismissal motion will determine the next stage of Patrick’s case.
