Republican Judge-Elect Wins Arkansas Election Despite Multiple Criminal Charges Over Alleged Attack on His Wife

An Arkansas Republican who is facing multiple criminal charges stemming from allegations that he assaulted his wife has been elected as the next judge of Benton County, despite calls for him to abandon his political career.

Austin McCollum, 35, a former state representative, won the Benton County judge position in the November 3 election. His victory has attracted national attention because he is facing criminal proceedings involving alleged domestic violence and violations of a protective order.

McCollum had secured the Republican nomination in March and was running unopposed in the general election. His name did not appear individually on the ballot, but he was included in the unopposed candidates section.

His election came despite two separate criminal cases involving allegations made by his wife, Ragen Ashlee McCollum, 34.

Wife describes alleged violent attack

McCollum was first arrested on August 1 after deputies responded to a disturbance at the couple’s home in Bentonville.

According to a probable-cause affidavit, investigators alleged that an argument escalated into a violent confrontation.

The document states that McCollum threw shoes at his wife, struck her with a clothes hanger and prevented her from leaving a bedroom.

He allegedly pinned her face down on a bed, placing his knee against the back of her neck and restricting her ability to breathe.

When she managed to reach the bedroom door, he allegedly slammed it against her hand before punching her in the face, throwing her to the floor and repeatedly striking her head against the ground.

Another family member reportedly contacted emergency services.

Deputies who arrived at the property described seeing blood on McCollum’s arms and legs, along with injuries to his knuckles.

McCollum was released after posting a $10,000 bond. He subsequently pleaded not guilty to the charges.

Wife obtains protective order and files for divorce

Ragen later obtained a protective order requiring McCollum to stay at least 1,500 feet away from her.

She also filed for divorce on August 7. In court documents, she described what she said was a pattern of controlling and abusive behavior during their marriage.

In testimony reported by the Daily Mail, she alleged that her husband expected her to become a so-called “Proverbs 31” wife, referring to a biblical passage traditionally associated with a woman’s devotion to her husband and family.

The couple have two young children, aged two and four.

These claims remain allegations and have not been established as criminal findings against McCollum.

Arrested again over alleged protective-order violations

The legal troubles did not end with his first arrest.

McCollum was arrested again on September 29 on suspicion of stalking and violating the protective order.

According to court documents reported by local media, he allegedly appeared at an open house at Shiloh Christian School while his wife was present, despite knowing she would be there.

He was also accused of appearing at the children’s daycare in circumstances that allegedly violated the court’s restrictions.

Following the second arrest, a judge set a $150,000 cash-only bond. McCollum was released on October 6 after posting bond and was required to wear an electronic monitoring device.

As of November 2026, he faces multiple criminal charges across the two cases. His next court appearance is scheduled for December 1.

Former lawmaker now faces questions about taking office

McCollum served in the Arkansas House of Representatives from 2017 until his resignation in August, shortly after his first arrest.

His resignation followed calls from several prominent Republican officials, including Governor Sarah Huckabee Sanders, urging him to step down.

Despite the controversy, state election rules left no straightforward legal mechanism for the Republican Party to replace him on the November ballot after the deadline for candidate changes had passed.

He therefore remained the unopposed candidate and went on to win the election.

Benton County’s outgoing judge, Barry Moehring, has publicly urged McCollum not to take office, warning that the unresolved criminal cases could undermine confidence in county government.

Under Arkansas law, a person convicted of a felony can be disqualified from holding the office. McCollum has not been convicted and remains legally presumed innocent.

His election has created an unusual situation for Benton County: its incoming chief county official is facing multiple criminal proceedings even before beginning his new term.

For now, the criminal cases are expected to continue into December, leaving questions about his political future and whether he will ultimately assume the position.
